First off, no matter what circumstance, a traffic accident that ends in a fatality is a terribly tragic event for everyone who is involved. You have a very short period of time between when you are arrested and when the decision is made to file criminal charges against you.
There are a few instances when you could have the upper hand in your defense. It must be proven that you had complete control of the vehicle during the crash. You also must have had your Miranda Rights read to you properly, as well as had your field sobriety test performed correctly.
