First off, no matter what circumstance, a traffic accident that ends in a fatality is a terribly tragic event for everyone who is involved. Unfortunately for the defense, whenever alcohol is involved in a vehicle fatality, law enforcement will heavily prosecute, regardless of your intent. There are a few instances when you could have the upper hand in your defense. It must be proven that you had complete control of the vehicle during the crash. You also must have had your Miranda Rights read to you properly, as well as had your field sobriety test performed correctly.
